<\/p>\nDAVID Walliams was recorded on the toilet after Britain's Got Talent bosses secretly left his microphone on, bombshell court documents claim.<\/p>\n
The telly star, 52, has now lodged a \u00a310million High Court claim against the makers of the hit\u00a0ITV\u00a0show. <\/p>\n

The Sun exclusively revealed yesterday Walliams was taking the bosses to court after he suffered suicidal thoughts when he was axed from Britain's Got Talent.<\/p>\n
The 52-year-old was sacked from\u00a0the hit show last year after jibes he made about contestants were leaked. <\/p>\n
The High Court writ says Walliams was recorded on by Fremantle Media, and he claimed they \u201crecorded, transcribed and retained\u201d private conversations for ten years.<\/p>\n
And he claims fellow judges\u00a0Simon Cowell,\u00a0Amanda Holden\u00a0and\u00a0Alesha Dixon\u00a0were monitored the same way by production staff.<\/p>\n
In a 21-page legal document Walliam's lawyers say: \u201cThe Claimant (Walliams) now understands that, unknown to him at the time, his microphone was kept on and recording throughout the whole filming day, including breaks, \u00adduring his whole tenure as a judge on the show.\u201d<\/p>\n He says this even happened when he went to the toilet. <\/p>\n Walliams' claim alleges Fremantle \u201cproduced and retained transcripts of the audio recordings of everything he said during that time, including the private information that had no relevance to production of the show\u201d.<\/p>\n Walliams complains some of the recorded material was private \u2014 including heart-to-hearts with Alesha about his\u00a0marriage,\u00a0divorce, spending sprees, sex life, \u00adrelationships\u00a0and his physical and\u00a0mental health.<\/p>\n <\/span><\/p>\n <\/span><\/p>\n <\/span><\/p>\n <\/span><\/p>\n They also covered the funnyman\u2019s political views, reasons behind his atheism and family disputes, his battle with food addiction, weight problems, his opinions of other celebrities and even the impact of his father\u2019s death. <\/p>\n Walliams says he had no idea of the extent of the surveillance until his \u201cdisrespectful\u201d remarks about two hopefuls were leaked to The Guardian, he claims, and published on November 10 last year.<\/p>\n The newspaper said it had obtained and reviewed \u201ctranscripts of the judges\u2019 comments for three days\u201d at the\u00a0London\u00a0Palladium in January 2020.<\/p>\n Walliams called one man a \u201cc***\u201d three times and said of a woman: \u201cShe thinks you want to f*** her, but you don\u2019t.\u201d<\/p>\n He apologised at the time and insisted the comments were taken from \u00ad\u201cprivate conversations\u201d not intended to be shared.<\/p>\n But an offer to remain on the judges panel for this year\u2019s show was withdrawn on December 14 and he was later replaced by ex-Strictly\u00a0judge\u00a0Bruno Tonioli.<\/p>\n Walliams, who says he has \u00adsuffered suicidal thoughts after being cancelled from public life, is seeking \u00a31m he stood to get from the prime-time ITV show, plus \u00a31.7m in lost earnings from the last year.<\/p>\n He wants an additional \u00a33.4m covering\u00a0future\u00a0losses over at least the\u00a0next\u00a0two years, taking the total to \u00a36.1m.<\/p>\n In addition he is seeking further unspecified damages for psychiatric harm, distress and upset and the loss of control over his private information and legal costs \u2014 which sources say could bring the total up to as much as \u00a310m. <\/p>\n Walliams' earnings plummeted from \u00a33.7m in 2022 to just \u00a3101,800 in the first five months of this year, the papers reveal.<\/p>\n He said in that time he has received only one new work booking, having \u201ccatastrophic results for his reputation and career\u201d.<\/p>\n Last night lawyers for Walliams declined to comment.<\/p>\n Fremantle said: \u201cWe had a long and productive relationship with David and so are surprised and saddened by this legal action.<\/p>\n![](\"https:\/\/www.thesun.co.uk\/wp-content\/uploads\/2023\/10\/TM-comp-David-v2.jpg\")
